ApnaSell is a digital marketplace and advertising platform designed to facilitate property listings, discovery, marketing, and user-to-user communication related to real estate and allied services. ApnaSell is not a real estate broker, agent, developer, financial institution, or legal advisor.

We do not participate in negotiations, property visits, documentation, title verification, payment handling between users, or transaction closures. All transactions, communications, negotiations, agreements, and disputes occur solely between users.

2. Definitions

• "Account": A registered user profile created on ApnaSell.
• "Advertisement" or "Ad": Any paid or unpaid promotional content.
• "Agent": Any intermediary, broker, or representative posting listings on behalf of others.
• "Applicable Law": Includes all Indian central, state, and local laws, including the Information Technology Act, 2000, Consumer Protection Act, 2019, and rules thereunder.
• "Listing": Any property advertisement posted on the Platform.
• "Paid Services": Subscriptions, featured listings, boosts, verification badges, banner ads, lead packages, or any monetized service.

3. Eligibility Criteria

To use ApnaSell, the following criteria must be met:

• You must be at least 18 years of age and legally competent to enter into contracts under the Indian Contract Act, 1872.
• Businesses, builders, developers, and agents must ensure they possess all required registrations (RERA), licenses, approvals, and authorizations.
• You represent that all information provided is truthful, accurate, and complies with Applicable Law.

4. Account Management

4.1 Registration Obligations: You must provide accurate, current, and complete information during registration and keep it updated.

4.2 Credential Security: You are solely responsible for safeguarding your login credentials. ApnaSell shall not be liable for unauthorized access caused by your negligence.

4.3 Verification: Any verification badge or status indicates limited checks only and does not certify ownership, legality, or transaction safety.

5. Usage Guidelines

Users agree to use the Platform only for lawful purposes, respect other users’ rights, and not interfere with Platform security or operations. ApnaSell may monitor usage for compliance and enforce limits or restrictions.

• Ownership & Authority: You represent that you have legal authority to advertise the property.
• No Transaction Guarantee: ApnaSell does not guarantee inquiries, leads, sales, rentals, or deal closure.
• Removal & Moderation: We may edit, suspend, or remove listings without notice for violations.

7. User Content

Users retain ownership of their content. However, by uploading content, you grant ApnaSell a perpetual, worldwide, royalty-free license to use, reproduce, distribute, and promote User Content. You are solely responsible for User Content and any consequences arising from it.

8. Communication

By using the Platform, you consent to receive communications via email, SMS, WhatsApp, phone calls, push notifications, or in-app messages. ApnaSell is not responsible for communications, meetings, or agreements between users.

9. Paid Services

Paid Services enhance visibility only and do not guarantee results. All fees are exclusive of applicable taxes unless stated otherwise. ApnaSell may modify or discontinue Paid Services at any time.

10. Refunds & Cancellations

Payments are non-refundable, except where required by law or explicitly stated. There are no refunds for unused periods, suspensions, or removals due to violations.

11. Intellectual Property

All Platform software, design, branding, trademarks, and content (excluding User Content) are the exclusive property of ApnaSell. Unauthorized use is strictly prohibited.

12. Prohibited Activities

Users shall not:

• Post fake, duplicate, or misleading listings.
• Engage in fraud, impersonation, or scams.
• Violate intellectual property rights.
• Scrape or harvest data (Data Mining).
• Upload malware or malicious code.

13. Data Privacy

Use of the Platform is subject to our Privacy Policy. ApnaSell complies with applicable Indian data protection laws.

These Terms shall be governed by the laws of India. Courts located in India shall have exclusive jurisdiction. ApnaSell may, at its discretion, require arbitration.
